First responders such as firefighters, police and emergency medical technicians give extraordinary sacrifices for our communities. Our country is reminded of this on this tragic day in the United States’ history, 9-11 will never be forgotten. The Cincinnati Paralegal Association, Pro Bono Committee wanted to find a way to give back to these brave men and women. Once you have a will, living will, health care proxy, or advance health care directive, you should keep it among your important papers. Make sure a responsible adult, such as the named health care proxy, knows where you keep these documents. If you have a regular physician who keeps your medical records, you should provide a copy of the document to him or her for your medical records. In the event you are admitted to a hospital, you should take this document with you at the time you are admitted and permit the hospital to place a copy of it into your medical file. It is also a good idea to discuss the decisions you have made in your document with family members so that they may better know and understand your wishes concerning these matters.
Just so that you have a basic understanding of the typical documents in an estate plan:
Will. The will: A will is the basic, legally binding instrument that expresses a person’s intentions after the person’s death. In your will you can designate a personal representative to oversee the distribution of your assets, including personal property and mementos, according to instructions you have included in the will. When writing a will you also will nominate a guardian for your minor children. A “pour-over will” provides that assets automatically are transferred to a trust in the event of your death
Living Will. A written statement detailing a person’s desires for medical treatment in scenarios where he or she is no longer able to express informed consent.
Health Care Power of Attorney. A written statement which allows for someone else to be designated as an agent or representative, in the event the person is unable to communicate decisions about health care.
Financial Power of Attorney. A written statement arranging for someone to manage finances in the event the individual becomes incapacitated or otherwise unable to make decisions on one’s own behalf.
Designation of Personal Representative. A written statement, different than a health care power of attorney, that allows an individual to give authority to another to access what would otherwise be protected health care information. It is important to note this person would not have authority to make health care decisions on behalf of the person.
